2. Contract Formation
Nothing on this website constitutes a contractual offer capable of acceptance.
Your order constitutes an offer to purchase goods from us.
A binding contract is formed only when we send you an order confirmation email confirming that your goods have been dispatched.
We reserve the right to decline or cancel any order prior to dispatch for any reason, including but not limited to pricing errors, stock issues, or suspected fraudulent activity.
3. Products
We manufacture and supply foam products, including custom-cut and made-to-measure items.
Product images are for illustrative purposes only. Colours, textures and shades may vary slightly between batches.
Foam is a flexible material and may vary slightly in appearance depending on packaging and compression during transit.
4. Pricing and Payment
All prices displayed include VAT where applicable.
Delivery charges are calculated at checkout and clearly displayed before payment is taken.
Payment must be made in full at the time of ordering.
We reserve the right to change prices at any time. Price changes will not affect orders already confirmed.
CUSTOM AND MADE-TO-MEASURE PRODUCTS
5. Customer Measurement Responsibility
By placing an order for custom-cut or made-to-measure foam, you confirm that:
- All measurements provided are accurate
- You have checked dimensions carefully
- You accept responsibility for measurement errors
- You understand custom goods cannot be resold
We are not liable for incorrect fit resulting from incorrect measurements supplied by the customer.
Customers must allow suitable clearance if foam is intended to fit within a frame or cover.
6. Tolerances and Material Characteristics
Due to the compressible and flexible nature of foam:
- A cutting tolerance of approximately ±5mm to ±10mm may apply depending on the foam grade and size
- Foam may expand slightly after unpacking
- Minor surface marks from cutting may occur
These characteristics do not constitute defects.
Perception of firmness is subjective and may vary depending on:
- Body weight
- Base support
- Upholstery layers
- Personal preference
Returns cannot be accepted solely due to comfort preference.
7. Cancellation Rights (Custom Orders)
Under the Consumer Contracts Regulations 2013, the 14-day cooling-off period does not apply to:
- Goods made to your specifications
- Custom-cut or personalised foam products
Once production has commenced, custom orders cannot be cancelled or refunded unless the product is faulty.
NON-CUSTOM ITEMS
8. Cancellation Rights (Standard Products Only)
For non-custom goods, you have the right to cancel your order within 14 days of receiving the goods.
You must notify us in writing within 14 days of delivery.
Returned goods must be:
- Unused
- In original condition
- Not cut, altered or modified
Customers are responsible for return postage unless goods are faulty.
Refunds will be processed within 14 days of receiving returned goods.
DELIVERY
9. Delivery Times
Delivery times are estimates only and not guaranteed.
Unless otherwise agreed, goods will be delivered within 30 days in accordance with the
Consumer Contracts Regulations 2013.
10. Risk and Ownership
Risk in the goods passes to you when the goods come into your physical possession or the possession of a person identified by you to take delivery.
Ownership of the goods passes once full payment has been received.
11. Damage in Transit
We request that any visible damage, shortage, or delivery issue is reported within 48 hours of delivery to allow us to investigate with the courier promptly.
Photographic evidence may be required.
This does not affect your statutory rights.
FAULTY GOODS
12. Faults and Consumer Rights
Under the Consumer Rights Act 2015, goods must be:
- Of satisfactory quality
- Fit for purpose
- As described
If goods are faulty, you must notify us as soon as reasonably possible.
We may request photographic evidence before arranging replacement or refund.
Nothing in these Terms limits your statutory rights.
CHARGEBACKS AND PAYMENT DISPUTES
13. Payment Disputes
By placing an order, you agree to contact us directly to resolve any issue before initiating a payment dispute or chargeback.
All custom goods are manufactured specifically to the measurements provided by you and fall under the made-to-measure exemption under the Consumer Contracts Regulations 2013.
In the event of a payment dispute, we reserve the right to provide order records, measurement confirmations, production records and delivery confirmation as evidence to the payment provider.
LIMITATION OF LIABILITY
14. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability shall not exceed the total purchase price of the goods supplied.
- We shall not be liable for indirect or consequential losses.
- We are not responsible for incorrect measurements supplied by the customer.
- We are not liable for improper installation, misuse, or modification after delivery.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.

15. Intellectual Property
All website content, including text, graphics, images, branding and layout, is the property of Birmingham Foam Shop Ltd and may not be copied or reproduced without written permission.
